1. Acceptance of Terms

By visiting mastabaroofing.com (the "Website"), requesting a roofing estimate, contacting Mastaba Homes LLC, a New York limited liability company doing business as Mastaba Roofing ("Company," "we," "us," "our"), or using any of our services or our SMS text messaging program, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Website, services, or SMS program.

We may modify these Terms at any time. Material changes will be posted to our Website with an updated Effective Date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

2. Services Provided

Mastaba Roofing offers full-service residential and commercial roofing services including:

3. Free Estimates and Consultation

When you request a free roofing estimate from Mastaba Roofing, we will schedule an on-site inspection of your property, assess your roofing condition and materials, provide a detailed written estimate at no obligation or cost, and answer questions about roofing options and warranty coverage.

Estimates are valid for 30 days from the date provided unless otherwise specified. Pricing is subject to change if project scope changes or if significant time passes between estimate and start date. Estimates are not binding contracts until you sign a formal service agreement.

4. Pricing and Project Costs

Pricing is provided in written estimates after on-site assessment. Pricing displayed on the Website is general guidance and reflects average market ranges, not your specific project. Final pricing depends on roof size, pitch, materials selected, accessibility, and job complexity. Financing options (such as our $0 Down up to 140 Months program) are subject to credit approval and may include separate terms from our financing partners.

5. Workmanship Warranty

Mastaba Roofing offers a 10-Year Workmanship Warranty on roof installations and replacements completed by our team. Material warranties are provided directly by manufacturers (Atlas Shingles, Owens Corning, and others) per their terms. Specific warranty conditions, exclusions, and claim procedures are detailed in your individual service agreement.

6. Insurance and Liability

Mastaba Roofing is a fully insured roofing contractor. We carry general liability insurance and workers' compensation coverage as required by New York State law. Certificates of insurance are available upon request prior to work commencing. Our insurance coverage limits and obligations are set out in your service agreement.

7. Customer Responsibilities

By engaging us for services, you agree to:

• Provide accurate property information and access
• Ensure clear and safe access to the work area
• Move or protect personal property near work areas
• Pay invoices according to the terms in your service agreement
• Promptly notify us of any concerns or issues during or after work

8. SMS Text Messaging Program

Mastaba Roofing operates an SMS text messaging program for customer care and project communication. This section summarizes the program. Full details are provided in our SMS Terms.

8.1 Program Description

Our SMS program is strictly conversational. We send messages only to customers who opted in by checking a clearly labeled box on our Website forms or who initiated contact and gave explicit consent. Messages are limited to: quote and estimate replies, appointment scheduling, project status updates, arrival notifications, and follow-ups related to your specific project. We do not send marketing campaigns, promotional broadcasts, or messages unrelated to your inquiry.

8.2 Frequency, Charges, and Hours

Message frequency varies. Most customers receive up to 8 messages over the lifetime of their project. Message and data rates may apply based on your wireless plan. Outbound messages are sent only between 7:00 AM and 7:00 PM local time in the recipient's time zone.

8.3 Opt-In

Opt-in is voluntary and is captured through an unchecked checkbox on our Website forms. Consent to receive SMS messages is not a condition of any purchase.

8.4 Opt-Out

You can stop receiving SMS messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. You will receive one final confirmation message and no further texts will be sent. You may also opt out by emailing mastabahomesllc@gmail.com with "STOP SMS" in the subject line.

Wireless carriers are not liable for delayed or undelivered messages. Our SMS program is available on all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket Wireless, and most MVNOs.

9. Website Use and Acceptable Conduct

You agree not to use the Website for any unlawful purpose, to harass or harm others, to attempt to gain unauthorized access to any systems, or in any way that could damage, disable, or impair the Website.

10. Intellectual Property Rights

All content on our Website including text, images, logos, design, and code is the intellectual property of Mastaba Homes LLC or is used with permission. You may not reproduce, copy, distribute, modify, or create derivative works without explicit written permission. The Mastaba Roofing name and logo are trademarks of Mastaba Homes LLC and may not be used without authorization.

You retain ownership of any content you submit (reviews, testimonials, photos), but you grant Mastaba Roofing a non-exclusive license to use that content for marketing and promotional purposes.

EXCEPT AS EXPRESSLY PROVIDED IN A SIGNED SERVICE AGREEMENT, THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. Mastaba Roofing disclaims all warranties, express or implied, including:

12.2 Jurisdiction and Venue

All disputes shall be brought exclusively in the state or federal courts located in Fulton County or Albany County, New York. You consent to the personal jurisdiction of these courts. This choice of forum does not prevent you from bringing claims in small claims court if eligible.

12.3 Informal Dispute Resolution

13. Indemnification

You agree to indemnify and hold harmless Mastaba Homes LLC and its members, employees, and agents from any claims, damages, or costs (including attorney fees) arising from your use of the Website in violation of these Terms, your violation of applicable laws, your infringement of third-party rights, your negligence or misconduct, or content you submit. This indemnification does not apply to claims arising solely from our negligence or willful misconduct.
