If you do not agree to these Terms, please do not use our Website or services. These Terms constitute a legally binding agreement between you and Mastaba Roofing, LLC regarding all roofing services, estimates, and Website use.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our Website. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

2. Services Provided

Mastaba Roofing offers full-service residential and commercial roofing services including:

Estimates are valid for 30 days from the date provided unless otherwise specified. Pricing is subject to change if project scope changes or if significant time passes between estimate and start date. Estimates are not a binding contract until you sign a formal service agreement.

4. Pricing & Payment Terms

4.1 Estimates & Accuracy

All written estimates include labor, materials, and applicable taxes. Prices are guaranteed provided:

• Work begins within 30 days of estimate date
• Project scope remains unchanged from the estimate
• No hidden or additional structural issues are discovered during work

If unforeseen issues are discovered during work (hidden damage, structural problems, additional materials needed), we will notify you immediately with a supplemental estimate before proceeding.

4.2 Payment Terms

Payment terms are specified in your individual service contract and estimate. Generally:

• Deposit: 25-50% due to schedule work (refundable if you cancel before work starts)
• Final Payment: Remaining balance due upon completion and final walkthrough
• Financing: We offer flexible financing with $0 down and payment plans from 12-140 months (subject to credit approval)
• Accepted Methods: Cash, check, credit card, debit card, and financing arrangements

We will not begin work until all payment arrangements are finalized. Failure to make agreed payments may result in work stoppage and potential legal action.

5. Service Schedule & Project Timeline

Once you schedule work with Mastaba Roofing, we will provide a realistic project timeline. We take pride in completing projects on schedule, but we cannot guarantee specific dates due to weather conditions, material delays, or unforeseen site conditions. We will communicate any delays with you promptly.

Factors that may affect project timeline include weather (rain, snow, wind), structural damage requiring additional work, material availability, and permit requirements. Work will not proceed during unsafe weather conditions. We prioritize safety and quality over speed.

6. Warranty Coverage

6.1 10-Year Workmanship Warranty

Mastaba Roofing guarantees all workmanship for 10 years from the completion date. This warranty covers:

• Installation defects or improper workmanship
• Leaks caused by our installation or work quality
• Shingle failures due to improper installation
• Flashing and ventilation defects

If any defect in our workmanship is discovered within 10 years, we will return and repair it at no cost to you. This is a comprehensive guarantee that protects your investment in your roof.

6.2 Material Manufacturer Warranty

All materials used (shingles, metal, underlayment, flashing) come with the manufacturer's warranty. Typical coverage includes:

• Asphalt Shingles (GAF, CertainTeed, Atlas): 25-30 year material warranty
• Metal Roofing: 40-50+ year material warranty
• Flat Roof Systems (TPO, EPDM): 10-20 year material warranty

Material warranty claims are filed with the manufacturer directly. We will assist you with warranty claims and documentation. Material warranty terms vary by manufacturer and product selected. Your estimate will specify exact warranty terms for your roofing materials.

6.3 Warranty Exclusions

Our 10-year warranty does NOT cover:

• Damage from severe storms, high winds, hail, or natural disasters
• Damage from lack of maintenance or roof neglect by homeowner
• Damage from improper attic ventilation or interior moisture issues
• Damage from roof penetrations, skylights, or equipment installed after our work
• Cosmetic issues, discoloration, or granule loss from normal weathering
• Damage from improper weight/load placement on roof
• Pre-existing damage not identified during initial inspection

Normal weathering, color fading, and minor granule loss are not warranty defects. Roofs require basic maintenance (gutter cleaning, moss removal in severe cases) to maximize lifespan.

7. Insurance & Liability Protection

7.1 Mastaba Roofing Insurance

Mastaba Roofing is fully insured with comprehensive coverage including:

• General Liability Insurance: Covers property damage and bodily injury claims
• Workers Compensation Insurance: Covers all crew members and employees
• Coverage Amount: Minimum $2,000,000 general liability

We provide proof of insurance to all customers before work begins. You will have no liability for our crew members or their injuries — our insurance covers all work-related incidents. If any crew member is injured on your property, our workers compensation insurance covers all costs.

7.2 Limitations of Liability

EXCEPT FOR PERSONAL INJURY OR DEATH CAUSED BY OUR GROSS NEGLIGENCE, Mastaba Roofing's total liability for any claim arising from our services shall not exceed the total amount paid by the customer for the specific service or project. We are not liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of business, income, or profits
• Damage to property inside the home (interior damage, water intrusion)
• Cosmetic or aesthetic issues not directly caused by our work

This limitation applies to all claims including negligence, breach of warranty, or breach of contract. If you have property damage coverage through homeowner's insurance, we recommend filing claims through your insurance for the fastest resolution.

8. Website Use & User Conduct

When using our Website, you agree not to:

• Use the Website for illegal purposes or in violation of local, state, or federal laws
• Transmit viruses, malware, or any code of destructive nature
• Attempt to gain unauthorized access to Website systems or data

11.2 Jurisdiction & Venue

All disputes shall be brought exclusively in the courts of Albany County, New York. You consent to the personal jurisdiction of these courts and waive any objections to venue. This choice of forum does not prevent you from bringing claims in small claims court if eligible.
